Informed Consent and Waiver of Liability 

Parent enrolls Child for tennis instruction to be provided by TennisKids. Parent understands that there are no make-up classes in the event that Child misses a class due to his or her absence. This instruction program involves physical activity including but not limited to running, jumping, swinging of tennis racquets and quick starts and stops. Parent understands the inherent risks including possible injury that may result from Child’s participation in the program. Parent assumes the risk and hereby affirms that Child is in good physical condition and does not suffer from any disability or condition that would prevent Child from participation in the program. Parent on behalf of Parent and Child (collectively, “Releasors”) fully and completely releases and forever discharges TennisKids, and each of its present and former affiliates, officers, managers, directors, agents, employees, members, insurers, attorneys and representatives (collectively, the “Releasees”), of and from any and all actions, causes of action, in law or in equity, and any suits, debts, liens, contracts, agreements, promises, liabilities, claims, demands, damages, losses, costs and expenses, of any nature whatsoever, known or unknown, suspected or unsuspected, fixed or contingent, that any of Releasors have had or now have against the Releasees arising out of or based upon Child’s participation in the program. Parent authorizes TennisKids to use child’s image, voice or other likeness by means of television, radio, brochures, websites, email and other media for purposes including publicity, marketing and promotion of TennisKids without compensation. Parent grants TennisKids all right, title and interest in and to such material, including any copyright or other intellectual property rights therein. Parent releases TennisKids from any liability related to such use.


PARENT ACKNOWLEDGES THAT PARENT IS FAMILIAR WITH THE PROVISIONS OF CALIFORNIA CIVIL CODE SECTION 1542, WHICH PROVIDES AS
FOLLOWS: ”A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER
FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM, HER, OR IT MUST HAVE MATERIALLY AFFECTED HIS OR HER
SETTLEMENT WITH THE DEBTOR." PARENT HEREBY EXPRESSLY WAIVES ANY RIGHTS PARENT MAY HAVE THEREUNDER, AS WELL AS UNDER ANY
OTHER STATUTES OR COMMON LAW PRINCIPLES OF SIMILAR EFFECT WITH RESPECT TO THE CLAIMS RELEASED HEREIN.

Refund Policy

    • Refunds will not be issued for non-attendance at a scheduled class.
    • Refunds apply when the withdrawal of a student is received in writing 1 week prior to the start of any season.
    • Should TennisKids find it necessary to de-register a child, a refund will be issued after deduction for classes already attended.
Make Up Classes & Cancellations
    • There will be a maximum of two make-up days due to inclement weather

    • TennisKids reserves the right to cancel any program due to insufficient enrollment. Upon cancellation, a full refund will be made.

An account must be created in order to: complete an order or registration on TennisKids.net, register for an account on TennisKids.net, or to enter certain TennisKids.net promotions/contests/sweepstakes.

When creating an account, we ask you for your full name, email address, a password, shipping address, and some other information. If you are making a purchase, you will have to provide your billing address, and credit card information. Your credit card and billing information is stored by the payment-processing center but isn't saved on TennisKids.net to protect you from accidental identity theft. So you must reenter your credit card and billing information each time you place an order or register for a class on TennisKids.net.

Your information is used to process your orders and personalize your shopping experience on TennisKids.net, for internal purposes and to comply with any legal requirements. By storing your personal information on a secure server, TennisKids.net is able to shorten your checkout process and allow you to check your order or registration status online.

Our system also may gather information about the areas you visit on our site as well as the IP address you use to connect to our site. We may use this data internally only for 2 reasons: 1) to personalize your experience on TennisKids.net and the marketing materials you receive from TennisKids.net or its partners and 2) to prevent fraud on your account. We would not share any of this data on an individual basis (we may share it in an aggregate form without personal identifiers). We do use navigational information both in the aggregate and on an individual basis to understand how our visitors use TennisKids.net so that we can make our site better. We do not keep track of where you go on the World Wide Web.

We may use your purchase information about the products you buy from TennisKids.net  or the classes you register for, to make other marketing offers to you. You must opt-in to join the mailing list in order to receive such offers. Except as provided above, as required by law, or in the event of a merger, consolidation, or sale of all or substantially all of TennisKids.net’s assets, we will not sell or otherwise share any of your purchase information with any third party without your permission.

Safeguarding Personal Information

TennisKids.net has implemented a variety of security measures to maintain the safety of your personal information. Your personal information is contained behind secured networks and is only accessible by a limited number of employees who have special access rights. When you place orders or access your personal information, we offer the use of a secure server. All sensitive/credit information supplied by you is transmitted via Secure Socket Layer (SSL) technology and securely stored in TennisKids.net’s database.

You can also check by looking at the URL bar on top of your browser. This line will typically show the first characters as "https" when a secure connection has been established rather than "http" which indicates a connection that is not secured.

Update Account Information

TennisKids.net provides a My Account feature on our website which allows you to modify and/or remove most of your personal information. This page can be accessed by clicking the account link at the top of every page on the site. Rest assured that all of your information within my account is secure and accessible only by you or limited TennisKids.net personnel.

Use of "cookies"

A cookie is a small piece of information sent by a website that is saved on your hard disk by your computer's browser. The cookie holds information a site may need to personalize your experience and to gather website statistical data, such as which pages are visited, the internet provider's domain name and country that our visitors come from (e.g. "aol.com" or "msn.com") and the addresses of the sites visited immediately before coming to and immediately after leaving TennisKids.net. Alternately, if you have created an account with TennisKids.net, you can also remove your email address from our list of addresses that receive information about new products, service, sales and promotions by clicking on the Account button that appears on most every page of our Website, logging into your account, and making the appropriate change.

Your password is your key to your personal information on TennisKids.net - including your account information and your order information.
